DELAWARE, Ohio — A Marysville man is accused of kicking and trying to trip a Delaware County sheriff’s deputy after an arrest in Powell.
According to court documents, Brian P. Smith, 36, of Marysville, is charged with felonious assault after the incident at the Delaware County Jail.
Smith was originally taken to the jail by Powell police early Sunday morning on assault and disorderly conduct charges. Court documents say when he arrived at the jail, Smith was restrained using a hobble strap because he was being combative during his arrest.
When the strap was removed, deputies say Smith made a comment, asking corrections officers to remove his handcuffs so he could fight them. When corrections officers told Smith his cuffs would not be removed, they say he kicked the shin of a sergeant, and attempted to wrap his legs around him and trip him.
The original charges against Smith were both misdemeanors. The felonious assault charge from the incident at the jail is a 5th-degree felony.
Prosecutors asked for a $25,000 bond for Smith.
